Brazil Fines Apple $2 Million For Selling iPhones Without Charger

Brazil’s customer protection agency, Procon-SP has fined Apple the sum of ~US$2 million (R$ 10.55 million) for selling the iPhones without charger. The Sao-Paulo-based watchdog accused the tech giant of violating the country’s Consumer Defence Code “by misleading advertising, selling a device without the charger and unfair terms”.

During the launch of the iPhone 12, Apple announced the decision to stop including the brick wall chargers and earbuds, citing the environmental impact (reducing carbon emissions and use of rare earth metals), and alluded to the fact that most users have spare chargers. Despite that, Procon-SP did not believe these reasons were substantial enough because the Cupertino company has not been able to demonstrate significant environmental gains.

Another issue cited was Apple’s reluctance to repair iPhone 11 Pro smartphones with water damage as the agency believes that the company mislead consumers into believing that they are totally water resistant and eventually refused to repair those with water damage under warranty. The final issue raised the company deliberately slowing down older iPhones with iOS updates to encourage them to purchase newer models.

Apple’s decision to sell the iPhones without charger was initially mocked by competitors such as Samsung and Xiaomi, however, both companies launched their flagship smartphones without this accessory. For the Brazil market, Samsung had to reach an agreement with Proton-SP to include a gift charger with Galaxy S21 pre-orders. Similarly, Apple has the decision to pay the fine since it is an insignificant amount or reach an amicable amount wants to continue selling the iPhone in Brazil.
